1. Acceptance of Terms

By accessing or using NexChat ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms, you may not access or use the Service.

2. Description of Service

NexChat provides a real-time messaging platform that enables users to send text messages, share media files, create group conversations, and communicate with other users over the internet. The Service includes both a web application and supporting server infrastructure.

3. User Accounts

To use the Service, you must create an account by providing a valid email address or phone number. You are responsible for maintaining the confidentiality of your account credentials, including your password and authentication tokens.

You agree to:

• Provide accurate, current, and complete account information.
• Maintain and promptly update your account information.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Send spam, unsolicited messages, or engage in any form of harassment.
• Impersonate any person or entity or misrepresent your affiliation.
• Distribute malware, viruses, or any other harmful code.
• Attempt to gain unauthorized access to the Service, user accounts, or systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Collect or harvest user data without consent.
• Upload or share content that is illegal, obscene, defamatory, or infringes on intellectual property rights.

5. User Content

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant NexChat a non-exclusive, royalty-free, worldwide license to store, transmit, and display your content solely for the purpose of providing the Service to you.

NexChat does not pre-screen user content but reserves the right to remove or refuse any content that violates these Terms or applicable laws.

6. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

7. Security

NexChat implements industry-standard security measures including end-to-end encryption infrastructure, JWT-based authentication with token rotation, OTP verification, rate limiting, and input validation. However, no system is completely secure, and we cannot guarantee absolute protection against unauthorized access.

8. Third-Party Services

NexChat uses the following third-party services:

• PostgreSQL — Database storage.
• Redis — Caching and real-time message queuing.
• Cloudflare R2 — File and media storage.
• Twilio — SMS delivery for OTP verification.
• Resend / Nodemailer — Email delivery for OTP verification.
• Firebase Cloud Messaging — Push notifications.

These services have their own terms and privacy policies. NexChat is not responsible for the practices of third-party providers.

9. Termination

NexChat reserves the right to suspend or terminate your account at any time, without prior notice, for conduct that violates these Terms or is otherwise harmful to the Service, other users, or third parties.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and associated data by contacting us.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL NEXCHAT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

12. Changes to Terms

NexChat reserves the right to modify these Terms at any time. We will notify users of material changes via the Service or email. Continued use of the Service after changes constitute acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NexChat operates, without regard to its conflict of law provisions.
